1. Scope of application

These General Terms and Conditions (GTC) apply to all orders and contracts concluded via the online shop www.bloomingloft.ch. The online shop is operated by Malio GmbH.

By submitting an order, customers agree to the General Terms and Conditions valid at the time of ordering.

BLOOMINGLOFT reserves the right to amend these General Terms and Conditions at any time. The version published at the time of ordering shall apply.

2. Offer & Conclusion of contract

The products and prices displayed in the online shop constitute non-binding offers.

The purchase contract is concluded when the order confirmation is sent. Automatically generated order confirmations serve solely as confirmation of receipt and do not yet constitute a definitive commitment to deliver.

Errors, price changes and prior sale reserved.

3. Prices

All prices are in Swiss francs (CHF) and include statutory VAT.

Additional shipping costs are shown separately at checkout.

Orders of CHF 100 or more are delivered free of charge within Switzerland and Liechtenstein.

4. Delivery & Shipping

Delivery is available exclusively within Switzerland and Liechtenstein.

Smaller items are shipped by parcel service. Larger pieces of furniture and bulky items are delivered by a freight carrier.

As standard, delivery is made to the kerbside. Delivery to your home and additional services such as assembly or packaging disposal can be added for an extra charge.

Delivery times are stated directly on the respective product page. All information regarding delivery times is non-binding.

In the event of delivery delays due to force majeure, production bottlenecks or transport problems, there is no entitlement to compensation.

5. Acceptance of delivery

Customers are required to inspect the goods immediately upon receipt for completeness, accuracy and visible damage.

Transport damage or obvious defects must be reported in writing within 48 hours.

In the event of visible damage, we recommend noting it directly with the delivery driver or refusing to accept the delivery.

6. Additional services

Optional additional services such as:

• Delivery to your home
• Furniture assembly
• Packaging disposal
• Disposal of old furniture

are carried out by external partners and may be charged additionally.

Electrical installations are excluded.

7. Warranty

The statutory warranty period of 2 years from receipt of the goods applies.

Excluded from the warranty are:

• normal wear and tear
• improper use
• damage caused by incorrect assembly or care
• minor variations in colour and material

Complaints must be submitted in writing and accompanied by meaningful photographs.

8. Returns

Returns must be registered with BLOOMINGLOFT in advance.

Returns must be complete, in their original packaging, and securely packaged for transport.

Custom-made or specially ordered products are excluded from the right of return.

9. Retention of title

The goods remain the property of BLOOMINGLOFT until payment has been made in full.

10. Payment

The available payment methods are displayed at checkout.

When purchasing on invoice, the terms and conditions of the respective payment service provider also apply.

Purchase on invoice with an instalment payment option (POWERPAY)

MF Group / POWERPAY offers “purchase on invoice” as an external payment service provider.

With the individual invoice, you can easily pay for your online purchase by invoice. If you do not make payment within the specified period, you will subsequently receive a monthly invoice with an order overview in the following month.

Upon conclusion of the purchase contract, POWERPAY takes over the resulting invoice claim and handles the corresponding payment arrangements. When purchasing on invoice, you also accept the POWERPAY Terms and Conditions in addition to our Terms and Conditions.

In the event of late payment, reminder fees and default interest may be charged.

11. Cancellation & Changes

Subsequent changes to or cancellations of orders are possible only with BLOOMINGLOFT’s prior written consent. If the ordered goods are already in transit from the manufacturer to our warehouse or the shipping process has already been initiated, BLOOMINGLOFT will charge a cancellation fee of 20% of the purchase price paid in the event of cancellation.

BLOOMINGLOFT also reserves the right to charge any additional handling, procurement, or return costs incurred, provided that they exceed the cancellation fee and are legally permissible.

12. Liability

BLOOMINGLOFT shall be liable only for damages resulting from intentional or grossly negligent conduct.

Liability for indirect or consequential damages is excluded.

13. Data protection

BLOOMINGLOFT’s separate Privacy Policy shall apply.

14. Place of jurisdiction

Only Swiss law shall apply.

The place of jurisdiction is Rheineck, Switzerland.

15. Vouchers

Vouchers can only be redeemed in the online shop and cannot be combined with other promotions.

Cash payment is excluded.

16. Newsletters

Marketing emails and newsletters are sent only with the customer’s express consent.

Cancellation is possible at any time.
